Judge in Kyle Rittenhouse Case Drops Major Charge Ahead of Closing Arguments, Defense Motions for ‘Mistrial’

Kenosha County Judge Bruce Schroeder, the judge in the Kyle Rittenhouse case, dismissed the firearms charge against the defendant on Monday.

In addition to the weapons charge, Rittenhouse is charged with killing two men and injuring a third man during a Black Lives Matter riot in Kenosha, Wisconsin in August 2020. Rittenhouse’s defense maintains he acted in self-defense.

The judge laid out the requirements to meet the firearms charge, which stipulates that the rifle’s overall length must be under 26 inches or the barrel length must be under 16 inches. Since Rittenhouse’s rifle did not meet the requirements, the judge summarily dismissed the charge.

“Count 6 is dismissed,” Judge Schroeder said.

“This happened during a discussion between judge, defense, and prosecution over jury instructions,” court reporter Angelica Sanchez noted.

The firearms charge itself is consistent with a prosecutorial pattern of dishonesty that has become a black mark on the entire trial. Judge Shroeder has notoriously reprimanded and even berated Binger for his prosecutorial antics.

Rittenhouse’s defense team has subsequently filed a motion for a mistrial, citing “prosecutorial misconduct.” If the motion is granted, Kyle Rittenhouse cannot be re-tried for the same crimes in this particular case.

“In their motion to dismiss, the Rittenhouse’s lawyer Corey Chirafisi argued that prosecutors violated Rittenhouse’s rights by discussing his silence after the shootings and referencing a video that Judge Schroeder previously deemed inadmissible,” Tim Pool notes.

“Chirafisi said that a mistrial should be declared ‘with prejudice,’ because they believe the prosecution may have been acting in ‘bad faith.’

Justice must be served in the Rittenhouse case, regardless if it is due to mistrial or a ‘not guilty’ verdict by a jury of his peers. Since there are reports that the jury has been targeted for mob intimidation, the judge may decide to take matters into his own hands. America will have to wait and see.
